    16th Session of the UPR

    Geneva, 22 April 2013 – Today the Universal Periodic Review Working Group opens its 16th session (22 April - 3 May 2013) in which it will review fourteen countries. 

    The UN Universal Periodic Review (UPR) is a significant innovation of the Human Rights Council which involves a review of the human rights records of all 193 UN Member States once every four and a half years. The reviews take place through an interactive discussion between the State under review and other UN Member States. The result of each review is reflected in an “outcome report” listing the recommendations the State under Review will have to implement before the next review.
     
    During this session, the following fourteen countries will be reviewed: Turkmenistan, Burkina Faso, Cape Verde, Colombia, Uzbekistan, Tuvalu, Germany, Djibouti, Canada, Bangladesh, Russian Federation, Azerbaijan, Cameroon and Cuba.

    Reports under Consideration during the 16th Session

    The reports under consideration during this session, namely – 1) the information prepared by each State under review (National report); 2) the compilation of UN information on the State under review prepared by the OHCHR (Compilation of UN information); and, 3) the summary of information submitted by other relevant stakeholders, also prepared by OHCHR (Summary of stakeholders' information)- are available on the UPR website.

    CRPD ratifications

    States under review in the 16th session of the UPR, that have not yet become parties to the CRPD, include Uzbekistan and Cameroon (which have signed the CRPD), and Tuvalu (which has not signed it). Countries that have yet to ratify the Optional Protocol include Cameroon (which has signed it), and Cape Verde, Colombia, Uzbekistan, Tuvalu, Canada, Russian Federation and Cuba (which have not signed it).

    DRAF and IDA Joint Press Release

    Side Event on Indigenous Women and Girls with Disabilities

    Geneva, 17 April 2013 - A side event on indigenous women and girls with disabilities, organised by the International Disability Alliance (IDA) and the Disability Rights Advocacy Fund (DRAF), was held today during the half day of general discussion on women and girls with disabilities of the Committee on the Rights of Persons with Disabilities.

    Today the Committee on the Rights of Persons with Disabilities (CRPD Committee) has held a half day of general discussion on the theme of women and girls with disabilities. The Committee chose this topic given the scarcity of information on the situation of women and girls with disabilities in the State Reports reviewed so far by the Committee.  In connection with this discussion, IDA and DRAF have co-hosted a side event on the rights of indigenous women and girls with disabilities.

    Held during the luncbreak of the half day of general discussion, the side event aimed to further the efforts made to address the rights of indigenous persons with disabilities (IPWD) and to explore the patterns of intersectional and multiple discrimination faced by indigenous women and girls with disabilities. Chaired by Catalina Devandas (DRAF), the speakers included Olga Montufar, Doreen Demas and Gayle Rankine, three indigenous women with disabilities from Mexico, Canada and Australia, respectively.  CRPD Committee member, Silvia Quan also took part in the panel and highlighted the Committee’s interest in the situation of indigenous populations with disabilities.  Recognising the many barriers facing indigenous populations with disabilities, not least the high percentage of indigenous people living in exclusion in remote communities, she confirmed that the Committee would continue to explore this topic.

    Indigenous women and girls with disabilities face discrimination in the exercise and enjoyment of their rights on multiple grounds, on the basis of their gender, disability, age and indigenous background. They are considered as one of the most marginalised groups in society whose traditional roles in their communities have been lost due to colonisation, assimilation and segregation.  In addition, indigenous women and girls with disabilities are subjected to the violent and harmful practices which other women and girls with disabilities are common victims, among others, to sexual abuse, domestic violence, forced sterilisation and neglect.

    Catalina Devandas announced that “DRAF is currently financing a project, implemented by IDA, to promote the rights of IPWD. Last year the IDA and DRF supported the UNPFII members in drafting a report on the situation of IPWD, the report that will be presented at the 12th session of the Forum (May 2013), includes a section on indigenous women and girls with disabilities. We would like to call on UN missions in Geneva to address the situation of IPWD, in particular girls and women, in their work in the Human Rights Council and in the UPR process”.

    Opening Session of the CRPD Committee´s 9th Session

    Geneva, 15 April 2013 – Today the Committee on the Rights of Persons with Disabilities opened its 9th session (15-19 April 2013) in which it will review Paraguay, adopt List of Issues on Australia, Austria and El Salvador and hold a half day of general discussion on women and girls with disabilities.

    The opening of the 9th session took place this morning in a public session from 10am to 1pm. Five new members (Martin Babu Mwesigwa, Monthian Buntan, Laszlo Lovaszy, Diane Mulligan and Safak Pavey) pronounced their solemn declaration to formally join the Committee. Ron McCallum stepped down from his position as Chair and Maria Soledad Cisternas Reyes was elected by an overwhelming majority as the new Chair. She is the first woman Chair of the Committee. Ron McCallum, Theresia Degener and Carlos Rios Espinosa were elected as new Vice Chairs and new Committee member Martin Babu Mwesigwa was elected as new Rapporteur of the Committee by acclamation.

    The OHCHR and several UN agencies provided information on their work to promote the rights of persons with disabilities and statements were also made by civil society organisations including the International Disability Alliance (IDA).

    In his statement, Yannis Vardakastanis, the Chair of IDA, called on the CRPD Committee to develop a paper on its relationship with NGOs, which highlights how civil society can input into the work of the Committee, and in particular which recognises the special role of DPOs in accordance with Article 4(3) of the CRPD. Further, Mr Vardakastanis highlighted IDA’s continuing work to mainstream CRPD standards across the treaty bodies including before the Human Rights Committee with respect to its General Comment no 25 on the right to political participation, which is not in full compliance with the CRPD. Mr Vardakastanis was able to inform the CRPD Committee of the clarified position adopted a few weeks ago by the Human Rights Committee which brings its interpretation of the right to political participation of persons with disabilities closer to CRPD standards. He also announced to the Committee that IDA launched the first issue of its Human Rights Publication Series, whose first issue is dedicated to the right to vote and to stand for election, which is a new annual journal dedicated to gathering and sharing practices and experiences related to CRPD implementation with a focus on positive examples of compliance.

    To conclude, Mr Vardakastanis welcomed the Committee´s initiative to hold a half day of general discussion on women and girls with disabilities on Wednesday 17 April 2013, during which IDA and DRAF will hold a side event on indigenous women and girls with disabilities with the objective of exploring the patterns of intersectional and multiple discrimination which make this group particularly vulnerable to violence and rights violations.

    The public opening was webcast live, including the provision of international sign interpretation, and will be archived on the treaty body webcast website.

    9th Session of the CRPD Committee

    Geneva, 15 April 2013 – Today the Committee on the Rights of Persons with Disabilities opens its 9th session (15-19 April 2013) in which it will review Paraguay, adopt List of Issues on Australia, Austria and El Salvador and hold a half day of general discussion on women and girls with disabilities.

    The Committee on the Rights of Persons with Disabilities (CRPD Committee) is the body of independent experts which monitors implementation of the Convention on the Rights of Persons with Disabilities by the States Parties. All States Parties are obliged to submit regular reports to the Committee on how the rights of persons with disabilities are being implemented. The Committee examines each report, holds an interactive dialogue with the State delegation in a public session and makes recommendations on the steps which should be taken to improve CRPD implementation.

    At the opening of the 9th session, taking place today at 10am, five new members (Martin Babu Mwesigwa, Monthian Buntan, Laszlo Lovaszy, Diane Mulligan and Safak Pavey) will pronounce their solemn declaration to formally join the Committee. Professor Ron McCallum is stepping down from his position as Chair and a new Chairperson and Committee bureau will be elected. Additionally, Mr Yannis Vardakastanis, IDA Chair, will deliver a statement during the opening. The opening session will be webcast live on the treaty body webcast website, along with all other public meetings of the Committee.

    Half-day of General Discussion on Women and Girls with Disabilities

    On 17 April 2013 from 12 - 6pm, the CRPD Committee will hold a half day of general discussion focusing on women and girls with disabilities. This topic has been chosen by the CRPD Committee given the scarcity of information on the situation of women and girls with disabilities in the State Reports reviewed so far by the Committee. 33 contributions have been received which can be found at www.ohchr.org/EN/HRBodies/CRPD/Pages/DGD17April2013.aspx (including IDA’s submission for this half day of general discussion).

    In connection with this discussion, the International Disability Alliance (IDA) will co-host together with Disability Rights Advocacy Fund (DRAF), a lunchtime side event on the rights of indigenous women and girls with disabilities. Speakers will include Olga Montufar, Doreen Demas and Gayle Rankine, three indigenous women with disabilities from Mexico, Canada and Australia, respectively. CRPD Committee member Silvia Quan has also kindly agreed to speak at the event.

    During this session, the following public and private* side events will also take place:

    • Wednesday 17 April (13:15 to 14:45) – public side event on indigenous women and girls with disabilities
    • Thursday 18 April (9:00 to 10:00) – private side event on El Salvador

    * Private side events are only open to civil society, NHRIs and UN agencies.

    All side events will take place at Palais Wilson with the exception of that on Australia and the side event on indigenous women and girls with disabilities which will take place in Room XX of Palais des Nations.

    IDA High Level Meetings in New York

    An IDA delegation, comprising the IDA Chair, Vice-Chair and Executive Director held, between 24-27 March 2013, a number of high level meetings in New York, with a particular focus on the High Level Meeting on Disability and Development that will take place on 23 September 2013 in the UN headquarters.

    During these days, the IDA delegation held more than twenty meetings with a good number of Ambassadors or Deputy Ambassadors of UN Missions, as well as with top officials of UN entities. In particular IDA had a joint meeting with the Ambassadors of Philippines and Spain, the two co-facilitators of the High Level Meeting on Disability and Development (HLMDD) and also met with the two co-chairs of the Open Ended Working Group working towards the Sustainable Development Goals (SDGs), the Ambassadors of Kenya and Hungary.

    The IDA delegation also attended a lunch meeting organized by the two co-chairs of the informal network of States friends to the Convention on the Rights of Persons with Disabilities (CRPD), the Ambassadors of Mexico and New Zealand. This well-attended meeting was focused on the HLMDD and the Conference of States Parties to the CRPD (COP) that will take place from 17-19 July 2013. IDA Vice-Chair, Javed Abidi, insisted during this and all the meetings on the need for the HLMDD to produce a change for people with disabilities in developing countries, which comprise 80% of the world’s population of persons with disabilities.

    The IDA delegation highlighted, during the meetings, the need to connect the HLMDD and the Special Summit on the MDGs that will take place on 25 September 2013, to reinforce the message that persons with disabilities need to be included in the post-2015 framework, “It is necessary that persons with disabilities are considered as a relevant stakeholder in all discussions on the post-2015 development framework” stated IDA´s Chair, Yannis Vardakastanis, after the meeting with the Ambassadors of Philippines and Spain “an ambitious HLMDD outcome document would help us to achieve this”.

    During the meeting with the Executive Director of UNICEF, the IDA delegation highlighted the leadership role UNICEF is playing among UN entities on how to mainstream disability rights and shared proposals on how this could further promoted at UN system-wide level. In the meeting with the UN DESA Undersecretary General, the IDA delegation highlighted the unique opportunity provided by the HLMDD and requested the support from DESA to ensure a good presence of DPO representatives from the Global South.

    Regarding the COP, the IDA delegation informed all relevant stakeholder that IDA will co-host together with DESA as in previous years the Civil Society CRPD Forum that will take place on 16 July 2013, the day prior of the start of the COP. The focus of this year’s Civil Society Forum will be on the HLMDD.

    La Serie de Publicaciones sobre Derechos Humanos de IDA es una revista anual dedicada a compartir y reunir información, prácticas y experiencias relacionadas con la aplicación de la Convención de la ONU sobre los Derechos de las Personas con Discapacidad (CDPD) de diferentes fuentes, incluidas las organizaciones de personas con discapacidad (OPDs), ONGs, instituciones nacionales de derechos humanos (INDHs), mecanismos de derechos humanos de Naciones Unidas y otros actores, con un enfoque centrado en destacar los ejemplos positivos en relación al cumplimiento de la CDPD. Su objetivo es responder a una gran demanda que solicita orientación adicional sobre la aplicación dada la diversidad y multiplicación de prácticas en todo el mundo.

    Por favor, haga clic en el enlace para tener acceso a la resolución sobre el derecho al trabajo y al empleo para las personas con discapacidad, que ha sido presentada por México y Nueva Zelanda en el Consejo de Derechos Humanos 22º período de sesiones.

    Esta resolución debería ser adoptada a finales de la próxima semana.

    Entre otros elementos positivos, debemos poner de relieve el uso del término "discapacidad psicosocial", y el buen lenguaje sobre la protección social y su relación con el empleo.
